I imagine the number of people who fall under DDA remit would far exceed the capacity of the lower deck.
The aim of adding grab rails, visual aids et al, was to make the vehicle accessible to all, with 'reasonable adjustment'.
Whether this all falls under reasonable adjustment is open to debate.
However, a partially sighted person has every right to sit upstairs.
